1. General
The information, software, and services made available on samsungtool.us and through the SamsungTool application (together, the "Software" and "Website") are provided by SamsungTool ("we", "us", or the "Company") on an "as is" and "as available" basis, for use by professional mobile device repair technicians and service centers.
By downloading, installing, accessing, or using the Software or the Website in any way, you acknowledge that you have read, understood, and agreed to this Disclaimer. This Disclaimer forms part of, and should be read together with, our End User License Agreement (EULA) and Privacy Policy. If you do not agree with any part of this Disclaimer, you must not use the Software or the Website.
2. Professional and Lawful Use Only
The Software is a professional repair tool intended solely for lawful repair, diagnostic, recovery, and maintenance work carried out on devices that their legitimate owners have voluntarily submitted for service.
You are responsible for ensuring that every operation you perform is authorized by the device's legitimate owner and is permitted under the laws that apply to you. The Company does not authorize, endorse, or accept any responsibility for the use of the Software to:
- service, unlock, or modify any device obtained through theft, fraud, or any other unlawful means;
- remove or bypass security, account, payment, screen, or carrier locks without the knowing consent of the device's legitimate owner;
- alter a device's IMEI or any other identifier for any purpose other than restoring the original, factory-assigned value; or
- gain unauthorized access to any device, data, account, or system.
You alone are responsible for how you use the Software. Any misuse is your sole responsibility, and you accept full legal liability for it.
3. No Warranty
To the maximum extent permitted by applicable law, the Company disclaims all warranties of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, satisfactory quality, title, or non-infringement.
We do not warrant that the Software will be uninterrupted, timely, secure, error-free, or free of harmful components; that it will meet your specific requirements; that any defect will be corrected; or that the results obtained through it will be accurate, complete, or reliable. You use the Software at your own discretion and risk, and you are solely responsible for choosing it for your purposes and for any results you obtain from it.
4. Assumption of Risk — Devices and Data
Repair, flashing, unlocking, and recovery operations are inherently technical and carry risk. Factors outside our control — including a device's condition, incorrect firmware selection, unstable power, faulty cables, interrupted connections, or user error — can lead to outcomes such as data loss or an inoperable ("bricked") device.
You acknowledge and accept that:
- you perform every operation at your own risk;
- you are solely responsible for backing up any data before working on a device; and
- the Company is not responsible for any loss of data, functionality, warranty, or value affecting any device serviced with the Software, however that loss arises.
We strongly recommend confirming device compatibility, selecting the correct firmware and options, and creating a full backup before performing any operation.
5. Legal Compliance Is Your Responsibility
Laws governing device repair, unlocking, security-lock removal, and identifier handling differ significantly from country to country, and some operations that the Software can technically perform may be restricted, regulated, or prohibited where you are located.
It is your sole responsibility to know and comply with all laws and regulations that apply to your use of the Software, including telecommunications, computer-misuse, consumer-protection, data-protection, and intellectual-property laws, as well as any applicable export or import controls. The availability of a feature within the Software is not a representation that using it is lawful in your jurisdiction or in any particular circumstance.
6. No Liability for Misuse or Third-Party Conduct
The Company is not liable for, and expressly disclaims responsibility for, any act or omission of any user, technician, employee, contractor, or third party who uses the Software, including any unlawful, negligent, or improper use.
If you operate a repair business, you are responsible for the conduct of everyone who uses the Software under your account. Any claim, loss, penalty, or liability arising from a violation of our EULA or of applicable law is the responsibility of the person or organization that committed it, and you agree to indemnify the Company against such claims as set out in the EULA.
7. Trademark Disclaimer
"Samsung" and all related names, marks, and logos are trademarks of Samsung Electronics Co., Ltd. SamsungTool and the Company are independent of, and are not affiliated with, endorsed by, sponsored by, or in any way officially connected to, Samsung Electronics Co., Ltd., any mobile network operator, or any other device manufacturer.
All brand names, product names, and model names referenced on the Website or within the Software are the property of their respective owners and are used solely to describe device compatibility. Their use does not imply any affiliation with, or endorsement by, those owners.
8. External Links
The Website and the Software may contain links to third-party websites, tools, or resources that are not owned or controlled by the Company. We provide these links only for convenience and do not review, endorse, or assume any responsibility for the content, products, services, privacy practices, or accuracy of any third-party resource. Accessing any linked resource is entirely at your own risk, and any dealings you have with a third party are solely between you and that third party.
9. Limitation of Liability
To the maximum extent permitted by applicable law, in no event will the Company, its affiliates, officers, directors, employees, licensors, or service providers be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages — including lost profits or revenue, business interruption, loss of data, or damage to devices — arising out of or relating to your use of, or inability to use, the Software or the Website, even if we have been advised of the possibility of such damages.
Where liability cannot be excluded, the Company's total cumulative liability arising out of or relating to the Software or the Website will not exceed the total amount you actually paid to the Company in the twelve (12) months immediately before the event giving rise to the claim. The full limitation-of-liability and indemnification terms are set out in our EULA and apply in addition to this Disclaimer.
10. No Professional or Legal Advice
Any information published on the Website, in the Documentation, or by our support team is provided for general informational purposes only and does not constitute legal, regulatory, or professional advice. You should not rely on it as a substitute for advice from a qualified professional. If you are unsure whether a particular operation is lawful or appropriate in your situation, seek independent professional or legal advice before proceeding.
11. Changes to This Disclaimer
We may update or revise this Disclaimer at any time to reflect changes to the Software, our practices, or applicable law. Any change takes effect when the updated Disclaimer is published on the Website, and the "Last updated" date above will be revised accordingly. Your continued use of the Software or the Website after a change is published means you accept the revised Disclaimer. We encourage you to review this page periodically.
